MI Unclaimed Property Reporting According to the Michigan Department of Treasury's website, Michigan's Uniform Unclaimed Property Act "requires businesses and government entities to report and remit to the Michigan Department of Treasury abandoned and unclaimed property belonging to owners whose last known address is in Michigan. In addition, every business or government entity that is incorporated in Michigan must report and remit abandoned property belonging to owners where there is no known address." Any asset (including, but not limited to, uncashed payroll checks, vendor checks and accounts receivable credit balances) belonging to a third party that remains unclaimed for a specified period of time is considered unclaimed property. Due Dates
The due date for filing the unclaimed property annual report is July 1 of each year for property reaching its dormancy period as of March 31. Instructions and forms for filing are available in the Manual for Reporting Unclaimed Property. Options for filing include free third-party software or paper forms, depending on the amount of unclaimed property being reported. Those without unclaimed property must file Form 4305, Attestation of Compliance with Unclaimed Property Reporting.
Voluntary Disclosure Program
Entities that have either not reported or under reported unclaimed property in the past are being given an opportunity by the Department of Treasury to voluntarily comply, ensuring no penalties or interest on property voluntarily remitted. Enrollment in the program can be completed by submitting Form 4869, Michigan Unclaimed Property Voluntary Disclosure Agreement by January 31, 2012 and requires disclosure and remittance of unclaimed property from the four previous years by July 1, 2012. Those entities without unclaimed property must file Form 4305, Attestation of Compliance with Unclaimed Property Reporting by January 31, 2012 and acknowledge that, if selected, an unclaimed property examination will cover the last 10 reportable years and may result in assessments of penalty and interest.
